Past due notice was recently sent to homeowners with a past due balance. The deadline for the payment is July 31, 2018.
The HOA Board has decided to take a more aggressive approach to collect delinquent payments. Article VI, Section 1 of the HOA Covenant and The Georgia Property Owners’ Association Act gives the HOA broad latitude in collecting the dues.
Effective August 1, 2018, homeowners with a past due balance will see one of the following measures being applied to collect the funds:
1. Lien placed on your home
2. Legal action through the correct channels leading up to garnishment of wages
A lien placed on a home prevents the homeowner from selling or refinancing until the lien is satisfied. Please take this matter seriously because it is not the intention of the HOA to resort to any of these steps, but in order to collect the dues these measures are necessary.
Garnishment of wages and Foreclosure will be used in the most extreme cases. This applies to homeowners with a past due balance of at least $2,000.00.
To recap, the deadline for sending the delinquent dues are July 31, 2018. Homeowners will be notified by certified mail of the appropriate action the HOA has applied. Furthermore, the HOA is required to provide a Closing letter in the event of a home being sold. If there is a past due balance the HOA Board will not furnish this letter to the closing attorney, which will severely impact the selling of your property. Basically, the home cannot be sold until this letter is sent.
